On 17 September 2002, President of URTiP, Witold Graboś, decided to impose a financial penalty of 1,000,000 PLN (one million zlotych) on Telekomunikacja Polska S.A. (the incumbent operator). The reason for the penalty is non-execution by TP S.A. of a decision of 15 February 2002 issued by President.
The above-mentioned decision introduced some modifications in the contract made between Netia Telecom Lublin and TP S.A. The purpose of the contract consisted in enabling subscribers of TP S.A. access to the Internet via dial-up modem through the Netia Telecom Lublin S.A network.
A control conducted by URTiP revealed that TP S.A. did not comply with the new conditions of telecommunication network connections which are specified in the decision of 15 February 2002. Thus TP S.A. has not provided users of connected networks with the largest possible access to telecommunication services.
In this context, on 8 August 2002, President of the URTiP initiated an administrative proceeding in order to impose a financial penalty on TP S.A. After receiving the clarifications and information on the income of the company for 2001, the President of URTiP made a decision to impose the financial penalty. In order to asses the amount of this penalty President took into consideration the degree of damage caused by the questioned practice, the degree of guilt by TP S.A. along with the so far activity of the company and its financial potential.
