Reduced charges for number portability

Fixed and mobile operators are reducing their charges for porting numbers when changing an operator.

The President of UKE, based on public opinion polls, presented on 28 March 2006 its position on this issue stating that one-off fees for porting the number when changing an operator both in mobile and fixed networks should not be more than 50 PLN.

The application of one-off fees for porting the number when changing an operator amounting to more than 50 PLN discourages people from using number portability, which is considered as failure to exercise the right in compliance with provisions of Article 71 (3) of the Telecommunications Law Act. Such behaviour of a telecommunications undertaking is subject to a financial penalty referred to in Article 209 and 210 of the Act (up to 3 per cent of  the undertaking’s revenue earned in the previous calendar year).

Due to the above-mentioned position, the President of UKE instituted proceedings in order to impose financial penalties for excessive charges for porting the number when changing an operator.

Despite the fact that proceedings in this case have not been completed yet, the Office is observing positive response from certain telecommunications undertakings which have reduced their charges. In fixed telephony these include:

  • Dialog S.A.,
  • Pilicka Telefonia Sp. z o.o.,

and in mobile telephony:

  • Polska Telefonia Komórkowa Centertel Sp. z o.o. (Orange),
  • Polska Telefonia Cyfrowa Sp. z o.o. (Era),
  • Polkomtel S.A. (Plus).

However, it should be stressed that not in all cases reduced prices reached the level recommended by the President of UKE (in some cases the gross price charged to the user is higher than 50 PLN) and reductions are not always permanent but only promotional. Such activities are not fully satisfactory for the President of UKE and for the subscribers and thus steps will be taken in order to further reduce the charges.
