The Telecommunications Council, an advisory body of the President of the Office of Telecommunications and Post Regulation has given a positive opinion on the “Assumptions to the new Telecommunications Law” elaborated by the Ministry of Infrastructure.
In the opinion of Wojciech Hałka, undersecretary of state in the Ministry of Infrastructure responsible for telecommunications sector who participated in the meeting, this document is supposed to raise a debate regarding the new legal solutions which should be implemented by Poland before the date of accession. They result from the new package of Directives 2002 which has been in force in the Member States since 25 July 2003.
The assumptions to the new Telecommunications Act prepared by the Ministry of Infrastructure have raised a lot of interest and discussion. Members of the Telecommunications Council pointed out the importance of precise definition of the universal service, specification of the scope of regulatory intervention on the telecommunications market and the relation between the regulator and operators as well as the strengthening of the regulator’s competencies in the aspect of the new tasks.
According to Witold Graboś, the President of the URTiP the problem is not only the question of adapting Polish Telecommunication Law to the new community regulations. A serious challenge is also preparation of the Office for operation under the new legal framework and providing the President of the URTiP with necessary regulatory tools.
In the resolution adopted on the 13th of November the Telecommunications Council concluded that the assumptions to the new Telecommunications Law Act prepared by the Ministry of Infrastructure may be the basis for the elaboration of regulations consistent with the present legal order of the European Union. The presented assumptions are in compliance with the direction of changes on the telecommunications market and give basis for legal regulations aimed at the acceleration of the telecommunication development.
By giving the positive opinion on the submitted assumptions, the members of the Telecommunications Council declared the willingness to participate in further work on the preparation of the draft Telecommunications Law.
