Amendment to the position of the President of UKE on Article 7 of the "mega-law"

Communication on the amendment of the position of the President of UKE on the provision of Internet access services free-of-charge or at a price lower than the market price by local government units - Article 7 of the Act of 7 May 2010 on supporting the development of telecommunications networks and services.

 

The President of UKE presents its amended position of 15 February 2011 on the provision of Internet access services free-of-charge or at a price lower than the market price by local government units. This position takes account of the position of 21 July 2011 on the provision of Internet access services free-of-charge or at a price lower than the market price by local government units by means of hot spots, in public locations, which replaces the position of the President of UKE of 25 August 2010.

Taking account of different options for the provision of Internet access services free-of-charge or at a price lower than the market price by local government units, the President of UKE takes the view that irrespective of the model for the provision of services either directly or by means of an entity selected under the tender procedure, local government units must register in the Register of local government units kept by the President of UKE on a case-by-case basis and file a request for approval and specification of conditions for the provision of this kind of services, under Article 7 of the Act. The request may be preceded by a question whether the planned telecommunications activity of local government units is subject to the procedure referred to in Article 7 (1) of the Act, in the case of providing Internet access services by local government units by means of hot spots in public locations.
