The President of the Office of Electronic Communications introduced two new categories in the Certification Programme of the President of UKE – ‘Disabled Friendly’ and ‘Junior’.
The certification programme of telecommunications services is implemented in order to promote fair and effective competition in the provision of telecommunications services and ensure that users, including users with disabilities, and minors have the best possible protection.
The President of UKE undertook measures related to the certification of telecommunications services with regard to the protection of young consumers, including the limitation of their access to inappropriate content available through Premium Rate services and via the Internet, as well as in order to maximize the protection of young service users from the negative influence of age inappropriate content.
The President of UKE wishes that all entrepreneurs working in the telecommunications market prepare their offers in such a way that they include solutions dedicated directly to people with disabilities, and also that the scope of these solutions go beyond the current one imposed under the Telecommunications Act.
The amendment of the Telecommunications Act (Art. 79c) – by the obligation to ensure, as far as technically possible, that end users with disabilities have access to the provided telephone services equivalent to the access to telephone services enjoyed by the majority of end users – imposed the obligation to provide facilities for people with disabilities on all providers of publicly available telephone services. Previously, such obligation was incumbent solely upon the entrepreneur designated to provide the universal service.
The aim of the Certificate of the President of UKE in the ‘Disabled Friendly’ category is to encourage telecommunication entrepreneurs (not only providers of publicly available telephone services, referred to in Art. 79c paragraph 1 of the Telecommunications Act) to create various types of facilities for people with disabilities in the access to the provided services as part of their offer (not only telephone services, referred to in the above-mentioned Art. 79c paragraph 1 of the Telecommunications Act, but also to other telecommunications services they provide), taking into account special needs of people with disabilities in the access to telecommunications services and assuming counteracting digital and at the same time social exclusion of these people.
In implementing the scheme the President of UKE is guided by the need to create equal opportunities for people with disabilities in the access to telecommunications services. This programme is designed to increase the activity of people with disabilities in the telecommunications services market. Its main aim is to create a special (voluntary) offer of facilities for people with disabilities in order to improve the effective functioning of these people in the telecommunications services market, thanks to more free use of new technologies and new cheaper forms of communication (especially those necessary for a given type and degree of disability).
By creating a certificate in the new ‘Junior’ category, the President of UKE would like to draw attention to the fact that the lack of block of Premium Rate services in young users’ phones/devices is an easy way for them to get access to content inappropriate for their age. Through the Premium Rate services young users may access different types of content, including erotic and pornographic content. In addition, the uncontrolled use of Premium services (premium rate SMS, MMS) results in very high telephone bills.
The main aim of the Certificate of the President of UKE in the ‘Junior’ category is to encourage entrepreneurs who provide their services in the telecommunications market to create a special offer dedicated to youngest users of telecommunications services, which will ensure a free and automatic block of premium rate calls (Premium Rate) as well as free and automatic block restricting access to inappropriate content over the Internet.
The programme also assumes promoting actions of entrepreneurs who have fulfilled specific conditions for granting the Certificate of the President of UKE in the ‘Junior’ category and have received this Certificate. The programme’s goal is also to get parents/legal guardians interested in the offer dedicated to youngest users.
The Certificate of the President of UKE in the ‘Disabled Friendly’ category and in the ‘Junior’ category is directed to all telecommunications entrepreneurs that meet the conditions defined by the President of UKE. A detailed description of the Programme of each of the above-mentioned categories as well as the conditions for participation and the procedure for obtaining the Certificate of the President of UKE, including i.a. the application process and the required documentation, are specified in the Regulations attached to this announcement.
Changes in the Regulations of the Certificate of the President of UKE in the Safe Internet category
Point 5 was added in chapter III ‘Conditions for Participation’ in the Regulations of the Certificate of the President of UKE in the ‘Safe Internet’ category.
According to this change the Applicant for the award of the Certificate of the President of UKE in the ‘Safe Internet’ category is obliged to provide on its web sites information to telecommunications services users on the legal consequences and ways to counteract content violating personal rights of telecommunications services users or other content of accusing, deriding and degrading character towards groups and individuals for reasons such as national, racial or ethnic origin, religious affiliation, gender, sexual orientation or disability as well as on contact details of organizations providing assistance to the victims of such content.

Applications may be submitted until 30th September of the year preceding the year for which the certificate is to be awarded (e.g. to be awarded the certificate for 2016 an application should be submitted until 30th September 2015). The request will be considered within 90 days from its submission at the latest. After the positive verification of the application, the Applicant will be immediately informed and invited to the award ceremony of the Certificate of the President of UKE.
The Certificate is awarded for a given calendar year. The Certificate can be extended for the following year. To this end, the stakeholder should submit the application again until 30th September of the year preceding the year the certificate is to be extended for, together with all the required documentation.
All stakeholders are encouraged to participate in the Certification Programme of the President of UKE in the ‘Disabled Friendly’ category and in the ‘Junior’ category as well as in ‘Safe Internet’, ‘Senior’ and ‘Comparison of Offers’ categories.
