The President of the Office of Electronic Communications is a regulatory authority responsible for telecommunications and postal activities, frequency resources management and compliance with criteria relating to electromagnetic compatibility.
It is also a specialised authority with respect to the inspection of
products radiating or susceptible to the radiation of electromagnetic
field, including apparatus and telecommunications equipment placed in
the Polish market.
The scope of tasks performed by the President of UKE is defined by the following legal acts:
- the Act of 16 July 2004 - Telecommunications Law (Telecommunications Act),
- the Act of 23 November 2012 - Postal Law (Postal Act),
- the Act of 30 August 2002 on conformity assessment system,
- the Act of 13 April 2007 on electromagnetic compatibility,
- the Act of 14 September 2012 on obligations relating to information on energy consumption by energy-using products, and control of the labelling of office equipment programme implementation,
- the Act of 7 May 2010 on supporting the development of services and telecommunications networks,
- the Act of 30 June 2011 on the launch of digital terrestrial television.
Main activities of the President of UKE in 2015:Auction for frequencies in the 800 MHz bands and 2600 MHz bands
On 10 October 2014 the President of UKE announced the auction for 19 general exclusive frequency licences in the 800 MHz and 2.6 GHz bands. The participants competed for 5 general exclusive frequency licences in the 800 MHz band and 14 general exclusive frequencies in the 2.6 GHz band. Six entities applied for the participation in the auction. All of them met formal requirements and were qualified to the 2nd stage of the auction. On 19 October 2015 the results of the auction were announced. Following administrative proceedings, on 25 January 2016, the President of UKE assigned the frequencies allocated within the auction.New functionality of the Location and Information Platform with a Central Database (PLI CBD)
The development of the PLI CBD unified the number portability processes. Thanks to building a central database of numbers which contains information about numbering resources assigned by the President of UKE, ported numbers and numbering data made available between the telecommunications undertakings, the system became an excellent tool for the telecommunications undertakings. It allows them to i.a. download data necessary for the correct routing of calls. In terms of mobile networks the functionality of number portability in PLI CBD was launched on 26 June 2015, and in terms of fixed network numbers - on 2 October 2015. Until the end of 2015 over 717 thousand numbers in mobile networks and over 108 thousand in fixed networks were ported with the use of the system.
Testing the quality of mobile services
The President of UKE conducted a comparison test of telecommunications services provided in the mobile networks by four undertakings holding the biggest shares in the market: Orange Polska S.A., P4 sp. z o.o., Polkomtel sp. z o.o., T-Mobile Polska S.A. The measurements were conducted across the country with the use of drive test by cars equipped with measurements sets allowing for a simultaneous measurement of services of all four operators. All towns with over 50 thousand citizens and national roads within the drive routes were subject to verification. The length of driven routes amounted to over 20 thousand km and the measurement time was over 500 hours. It was the biggest in Poland comparison test of the quality of services in mobile networks, conducted by an impartial entity with the use of transparent and trustworthy methodology. Its results gave data allowing i.a. for the assessment of the quality of services provided by the operators subject to testing and the state of the development of mobile telecommunications networks in Poland. The President of UKE implemented the project of building the Measurement and Control Tool (NPK) aimed at assessing the parameters of broadband networks rolled out with the use of the EU funds, and through that assessing the quality of the Internet access services provided to end users by the provider. NPK is to serve UKE experts to carry out technical operations (measurements) during the acceptance of broadband networks build with the use of EU funds, and end users of the Internet access services provided by the beneficiaries of the EU programmes. The application allows for carrying out of the measurements on terminal equipment - in fixed location and mobile - which use various operational systems, according to the methodologies recommended by the international standardisation organisations such as ETSI and ITU. Measurement and Control Tool will in the future become a basis for building a platform for testing the quality of Internet access service which will be made available by the President of UKE to a wide range of end users.Activities of the President of UKE for the benefit of consumers in individual cases
In 2015 the President of the Office of Electronic Communications conducted 2406 mediatory proceedings, 1476 (61.35%) of which were completed in favour of consumer. The Office examined 5223 applications for intervention, 4078 (78.08%) of which were completed in favour of consumers. Within the interventions and mediatory proceedings carried out by the President of UKE in 2015 the Office “recovered” 1 644 533.39 PLN for the benefit of consumers. Provision of the Internet access service by local government units
On 7 October 2015 the President of UKE amended the Position on the provision of Internet access service by local government units free of charge or at a charge that is lower than the market price. The amendments concern differentiation of basic technical conditions of providing Internet access service recommended by the President of UKE, taking into account the hotspot locations covering only and exclusively public places (within buildings of public interest and in the public open space without the possibility to use it in the place of residence of end users). The data uploading and downloading parameters with the maximum connection speed were increased in case of a free service - not more than 1 Mbit/s (it was 512 kbit/s up until then), and the monthly data transfer limit was raised in case of free Internet access service provided via hotspots localised in the public space - not more than 1 GB per user (it was 750 MB up until then).Multiplex 8 (MUX8)
On 12 March 2015 the President of UKE announced a contest for one general exclusive frequency licence (TV channels with 7 MHz bandwidth) in the 174-230 MHz band used in the radiocommunication broadcasting service, in the whole country area, intended for terrestrial digital broadcasting or re-broadcasting of TV programmes in multiplex 8 (MUX8). EmiTel sp. z o.o. was selected in the contest and on 2 October 2015 the President of UKE assigned one general exclusive frequency licence to this entity.Digital radio
Polskie Radio S.A. holds a frequency licence allowing for the digital radio broadcasting. In 2015, in order to launch new digital radio broadcasts in the T-DAB standard, the President of UKE issued the next 15 radio-licences. Currently, the digital radio signal broadcasted from the terrestrial transmitters covers about half of the Polish citizens and about 30% of the country area. The implementation schedule of the digital radio in Poland indicates that the whole territory of the country should be under coverage until December 2020.
Contest for the designation of postal operator to provide universal services
The contest for the designation of postal operator to provide universal postal services in the years 2016-2025 was announced by the President of UKE on 30 December 2014. On 20 May 2015 the President of UKE announced the contest results. On 30 June 2015, after conducting an administrative proceeding, the President of UKE issued a decision on selecting Poczta Polska S.A. as the designated operator to provide universal postal services in the years 2016-2025, in which the date for taking up the obligation of providing universal postal services was set on 1 January 2016 and the date of completing the obligation of providing universal postal services was set on 31 December 2025. The decision was made immediately enforceable.The President of UKE appointed as the Chairman of the World Summit on Information Society Forum 2015
During the World Summit on Information Society Forum 2015 (WSIS Forum 2015) held in Geneva in May, the President of UKE Magdalena Gaj was appointed as the Chairman of the Forum. Entrusting this prestigious function to the President of UKE was recognition of her international activities. Magdalena Gaj was the first Pole who held such an important function and one of the first women to chair such a big and important international conference dedicated to new technologies' influence on the sustainable development. During the WSIS Forum 2015, on 27 May 2015 the President of UKE received a prestigious award - a Gold Medal awarded by the ITU Secretary General in gratitude for the continuous engagement in the long-standing WSIS (World Summit of Information Society) process and chairing the WSIS Forum 2015.
